Can Your Work Phone You At Home Every Day You Are Off Sick? Is This Not Harassment?

If you are off ill in my work. The manager calls you back that morning in your home to check up. Then will call every day you are off. Is this right? when i worked as a manager I was not allowed to contact any employee’s at home if off sick?

I suppose it depends on what the manager gives as a reason for ringing you. If he/she openly admits that they’re checking up on you it is definitely not on and I would consider making a complaint.
If it’s a case of “Sorry to disturb you but I have a question” then it’s downright cheeky but I would say it doesn’t count as harassment.
If you have an ansaphone or mailbox I would ignore the calls and keep the message in case you want to take action.

As a manager i know that staff off sick think you dont care about them if you dont phone them. Daily calls are not necessary. A manager can phone you but can not be pushy with questions such as “when are you coming back?” etc. They should be supportive. “hope you get well soon, is there anything we can do for you etc?” But a manager can delve deeper if there is reason to believe you are skiving or you happen to be off sick everytime your football team is playing. They do pay your wages so it is two way traffic. A manager can also do a home visit in a supportive manner.

No – it is unethical. If you have called in sick, and spoken to a manager, then they have no reason to phone you at home. When you are well enough, THEN you can phone them and say, “I’m going to be back on ’such and such’ a day” Get a self certification form from the doctors surgery, or if you are off longer than 3 days, then get a sick line.
I would unplug the phone. Leave it on answering machine, and if they say anything – just say you were in bed asleep because You. Are. Not. Well.
In fact – I would get another job.

I’m not sure legally, but i believe that they are NOT allowed to phone you every day as it does become harassment. You should explain why you are not in work and if possible provide an anticipated return and that should be it. Sorry i don’t know the legal side, but i am positive they cannot phone you every day.

hi, i will be honest with you. I know a little about employment law my area is more of criminal law but i will try and aswer your question.
Firstly, your employer ‘ can’ call you from work and find out if you are ok, but only if you are certifying yourself off work sick… what i mean by this is; ” if you havent got a sick certificate from doctor”. Secondly, if you have this certificate and you have told your employer that you are off sick and you can prove it I do not see a reason why your employer should be calling you everyday…. and yes I would too think that its harrasment.
I would politely tell my boss to stop calling and that I will be in touch when Im better.

You may need to ask yourself if you have given them reason to check up on you. Are you trustworthy? Do you call in sick when you just want to go and do something else? If you are trustworthy and don’t play hooky, then I would suggest looking for another job because your boss seems too overbearing.

“Harassment” is not necessarily illegal. It may be contrary to company policy and if it is contrary to a contract, individual or union, you might be able to do something about it. However, there is no law that would absolutely prohibit an employer from calling an employee at home.

It depends what is it your contract.
Every day does seem excessive but alot of companies do have their employees contractually bound to be available to be contacted,usually by an occupational health department ,whilst they remain off sick.

when i was working i was told your employer cannot ring you at home cant remember why now but they never rang me when i was off sick you can always ring accas for the answer

It depends what your contract says. I wouldn’t call it harassment if you are not happy with them calling you everyday why dont you tell them that nicely.

it depends on what is written in your contract, if it states they will call you on sick days, then they are not doing anything illegal
